General Terms

Agreement between user and Vohra Staffing

Welcome to www.VohraStaffing.com. The www.VohraStaffing.com website (the “Site”) is comprised of various web pages operated by Vohra Staffing. www.VohraStaffing.com is offered to you conditioned on your acceptance without modification of terms, conditions, and notices contained herein (the “Terms”). Your use of www.VohraStaffing.com constitutes your agreement to all such terms. Please read these terms carefully and keep a copy of them for your reference.

Privacy

Your use of www.VohraStaffing.com is subject to Vohra Staffing Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications

Visiting www.VohraStaffing.com or sending emails to Vohra Staffing constitutes electronic communications which includes using mobile app, sms, cookie storage and push messaging. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, satisfy any legal requirements that such communications be in writing.

Your Account

Vohra Staffing facility users and candidates will not have full access to the Site Services without first becoming a “Registered User.” In order to use the full Site Services, you are required to set up an account through the Site and meet the other applicable eligibility requirements and conditions described in these Terms. You promise that all information you provide to us is true, accurate, current, and complete, and you agree to maintain and promptly update such information to keep it true, accurate, current and complete. You may not transfer or share your Account Credentials with any third parties, and you are solely responsible for maintaining the confidentiality of your Account Credentials. You acknowledge and agree that we rely on Account Credentials to know whether users accessing the Site and using the Site Services are authorized to do so. You are solely responsible for all use of your Account Credentials and Account and all activities that occur under or in connection with your Account Credentials or Account. You agree to be responsible for any act or omission of any users that access the Site or Services under your Account Credentials. You agree not to register for more than one Account or register for an Account on behalf of any third party.

Termination of Use or Registration

Vohra Staffing reserves the right, at its sole discretion, to immediately terminate your access to all or part of the Site or the Site Services, to remove your profile and/or any content posted by or about you from the Site, and/or to terminate your registration in Vohra Staffing, with or without notice should Vohra Staffing determine that you (i) have violated any terms stated herein, (ii) are not suitable for participation as a Registered User, or (iii) have misused or misappropriated Site content, including but not limited to use on a “mirrored,” competitive, or third-party site. In any event, Vohra Staffing also reserves the right, in its sole discretion, to terminate your access to all or part of the Vohra Staffing Site, to remove your profile and/or any content posted by or about you from the Site, and/or to terminate your registration in Vohra Staffing, for any reason, with or without notice. If we terminate your registration, we have no obligation to notify you of the reason, if any, for your termination, except to the extent required by the Fair Credit Reporting Act or other applicable law. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Florida and you hereby consent to the exclusive jurisdiction and venue of courts in Florida in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. Vohra Staffing’s decision to terminate an individual’s registration and/or to notify other Registered Users with whom we believe the individual has corresponded does not constitute, and should not be interpreted or used as, information bearing on the individual’s character, general reputation, personal characteristics, or mode of living.

Exclusive Use

A Registered User may use their account only to (i) find available work assignments with Vohra Staffing clients, (ii) correspond with Vohra Staffing regarding acceptance, performance and/or termination of accepted work assignments, (iii) communicate continued or discontinued availability for further work assignments, (iv) maintain or update credentials and (v) submit timesheets through Vohra Staffing regarding work performed. A Registered User may not assign or otherwise transfer their accounts to any other person or entity. As a condition of access to the Site and use of the Site Services, you agree to promptly notify Vohra Staffing if any component of your login credentials is lost, stolen, or otherwise compromised; and acknowledge that Vohra Staffing relies on the truthfulness of these representations and affirmations in determining your eligibility to use the Site and Site Services.

No Registered User has actual or apparent authority to sign agreements on behalf of Vohra Staffing or bind Vohra Staffing into a contract.

Comments

Users of the Site may post comments, reviews, and other content and submit suggestions, ideas, or other information, provided the content does not contain any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful content or content which is racially, ethnically or otherwise objectionable, or content which infringes upon the rights of any third party. You agree not to impersonate any person and/or other entity or communicate under a false name or a name you are not entitled or authorized to use. Vohra Staffing has the right (but not the obligation) to remove, prohibit, edit or discontinue any content on the Site, including content that has been posted by users.

If you post content or submit material you grant Vohra Staffing and its affiliates a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable right and license to make, use, sell, sublicense, reproduce, distribute, perform, display, prepare derivative works from and otherwise exploit all such content and material as if it were the full owner thereof. Furthermore, you grant Vohra Staffing, its affiliates, and sublicensees the right to use your name and/or username in connection with the content. You represent and warrant that all content and materials you provide shall be your original work product and will not be based on, or derived from, the proprietary information or items of a third party. You will defend and indemnify Vohra Staffing and its affiliates from any claims resulting from any content or materials you provide hereunder. In addition, Vohra Staffing may also sell, repurpose, aggregate, or transfer to third parties any information that you provide to Vohra Staffing and any additional information that can be obtained or determined from such information for any legally permissible purposes.

Content

You shall not transmit to Vohra Staffing or upload to this Site any Harmful Code or use or misappropriate the data on this Site for your own commercial gain. “Harmful Code” shall mean any software (sometimes referred to as “viruses,” “worms,” “trojan horses,” “time bombs,” “time locks,” “drop dead devices,” “traps,” “access codes,” “cancelbots” or “trap door devices”) that: (a) is intentionally designed to damage, disrupt, disable, harm, impair, interfere with, intercept, expropriate or otherwise impede in any manner, any data, storage media, program, system, equipment or communication, based on any event, including for example but not limited to (i) exceeding a number of copies, (ii) exceeding a number of users, (iii) passage of a period of time, (iv) advancement to a particular date or other numeral, or (v) use of a certain feature; or (b) would enable an unauthorized person to cause such result; or (c) would enable an unauthorized person to access another person's information without such other person's knowledge and permission.

Copyright Notices

You understand and acknowledge that the software, code, proprietary methods and systems used to provide the Site or Site Services are: (a) copyrighted by us and/or our licensors under United States and international copyright laws; (b) subject to other intellectual property and proprietary rights and laws; and (c) owned by Vohra Staffing or any licensors. The Site or Site Services may not be copied, modified, reproduced, republished, posted, transmitted, sold, offered for sale, or redistributed in any way without the prior written permission and the prior written permission of the applicable licensors. You must abide by all copyright notices, information, or restrictions contained in or attached to the Site or Site Services. Nothing in these Terms grant you any right to make or receive delivery of a copy of the Site or Site Services or to obtain access to the Vohra Staffing Site or Site Services except as generally and ordinarily permitted through the Site according to these Terms. Furthermore, nothing in these Terms will be deemed to grant, by implication, estoppel or otherwise, a license to the Vohra Staffing Site or Site Services. Certain of the names, logos, and other materials displayed on the Site constitute trademarks, trade names, service marks or logos (“Marks”) of VohraStaffing.com, its affiliates or other entities. You are not authorized to use any such Marks. Ownership of all such Marks and the goodwill associated therewith remains with us or those other entities. Any use of third-party software provided in connection with the Site or Site Services will be governed by such third parties' licenses and not by these Terms. For purposes of these Terms, the use of any such material on any other web site or networked computer environment is prohibited. All Marks are proprietary to Vohra Staffing or other respective owners that have granted Vohra Staffing the right and license to use such Marks. Any use of content or descriptions; any derivative use of this Site or its contents; and any use of data mining, robots, or similar data gathering, and extraction tools is strictly prohibited. In no event shall you frame any portion of the Site or any content contained therein.

Links to third party sites / third party services

www.VohraStaffing.com may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Vohra Staffing and Vohra Staffing is not responsible for the content of any Linked Sites, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Vohra Staffing is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Vohra Staffing of the site or any association with its operators.

Vohra Staffing may use third party vendors to provide an indication about whether license information appears valid. This information is intended as an initial screening tool, and not as a substitute for diligent vetting during your hiring process. Registered users who are unable to provide license information which appears valid may not be featured in searches, and other site functionality could be made unavailable to them. Indications about whether license information appears valid does not constitute, and should not be interpreted or used as, information bearing on the individual’s character, general reputation, personal characteristics, or mode of living.

Subscription Plans

Monthly Subscription: By purchasing a monthly subscription, you agree to an initial and recurring monthly subscription fee at the then-current monthly subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel your monthly subscription at any time subject to terms of our cancellation policy below.

Automatic monthly renewal terms: Once you subscribe Vohra Staffing will automatically process your monthly subscription fee in the next billing cycle. Vohra Staffing will continue to automatically process your monthly subscription fee each month at the then-current monthly subscription rate, until you cancel your subscription. Auto-renewing subscriptions cannot be cancelled mid-term.

Upgrading/Downgrading subscription plan: You can upgrade or downgrade your monthly subscription at anytime using the Manage Account page. If the user upgrades their subscription, this will take effect immediately. If the user downgrades their subscription prior to the end of their billing cycle, the downgrade will not go into effect until their next renewal.

Cancellation Policy: You may cancel your monthly subscription at any time by logging into the Manage Account Page and following the cancellation procedures described there. If you need help, feel free to contact us by emailing support@vohrastaffing.com or by calling support at 864-727-2726. Subscribers can cancel their monthly subscription immediately using the Manage Account page.

Users acknowledge that full value from a subscription can be provided in a small fraction of the subscription’s time period. Users further acknowledge their own role in staffing for their organization; services purchased do not guarantee successful staffing in any regard. Canceling a subscription means stopping the auto-renewal cycle. Vohra Staffing shall not be obligated to refund any portion of a subscription fee paid for current or previous periods of time. Cancelation requests submitted via the Manage Account page will take effect immediately; those submitted using any other method (email, phone, mail, etc) will take effect soon as our staff can process them on non-emergency timelines.

App Stores

You acknowledge and agree that the availability of the Vohra Staffing mobile application (“Application”) is dependent on the third party from whom you received the Application license, i.e., the Apple App Store or Google Play (“App Store”). You acknowledge that the Terms are between you and Vohra Staffing and not with the App Store. Vohra Staffing, not the App Store, is solely responsible for the Application, the content thereof, maintenance, support services, and warranty therefor, and addressing any claims relating thereto (e.g., product liability, legal compliance or intellectual property infringement). In order to use the Application, you must have access to a wireless network, and you agree to pay all fees associated with such access. You also agree to pay all fees (if any) charged by the App Store in connection with the Application. You agree to comply with, and your license to use the Application is conditioned upon your compliance with, the End-User License Agreement and all applicable third-party terms of agreement (e.g., the App Store’s terms and policies) when using the Application. You acknowledge that the App Store (and its subsidiaries) are third-party beneficiaries of the Terms and will have the right to enforce them.

No unlawful or prohibited use / intellectual property

You are granted a non-exclusive, non-transferable, revocable license to access and use www.VohraStaffing.com strictly in accordance with these terms of use. As a condition of your use of The Site, you warrant to Vohra Staffing that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Vohra Staffing or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Vohra Staffing content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular, you will not delete or alter any proprietary rights of attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of Vohra Staffing and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Vohra Staffing or our licensors except as expressly authorized by these Terms.

International users

The Service is controlled, operated and administered by Vohra Staffing from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Vohra Staffing content accessed through www.VohraStaffing.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Vohra Staffing, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of our inability to use the Site or services, any user posting made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Vohra Staffing reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Vohra Staffing in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in Broward County, Florida. The arbitrator’s award shall be final, and judgement may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of concerns from these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class action waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Vohra Staffing agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. VOHRA STAFFING AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

VOHRA STAFFING AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMAITON SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. VOHRA STAFFING AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOHRA STAFFING AND/OR ITS SUPPLIERS B ELIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTLA, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE ORE RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLICENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF VOHRASTAFFING OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination / access restriction

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Vohra Staffing as a result of this agreement or use of the Site. Vohra Staffing’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Vohra Staffing’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the SITE or information provided to or gathered by Vohra Staffing with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Vohra Staffing with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Vohra Staffing with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to terms

Vohra Staffing reserves the right, in its sole discretion, to change the Terms under which www.VohraStaffing.com is offered. The most current version of the Terms will supersede all previous versions. Vohra Staffing encourages you to periodically review the Terms to stay informed of our updates.
